Terms of Service
These Terms of Service (“Terms”) govern your use of caladriustherapy.com (the “Site”), operated by Caladrius Therapy, PLLC (“Caladrius Therapy,” “we,” “us,” or “our”). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
What these Terms cover
These Terms apply to information and tools made available through the Site, including pages describing our practice and therapists, the consultation form, the therapist match quiz, and links to our online booking and client portal. They do not govern the therapy services we provide to clients. Once a clinical relationship is established, separate intake paperwork, informed-consent forms, our Notice of Privacy Practices, and applicable law govern that relationship.
The Site is informational, not medical advice
Content on the Site — including pages about conditions, modalities, therapist profiles, blog posts, and the therapist match quiz — is provided for general informational purposes only. It is not medical, psychological, or mental-health advice and is not a substitute for diagnosis or treatment by a qualified licensed professional. Reading the Site, completing the quiz, or submitting the consultation form does not create a therapist-client, doctor-patient, or any other professional relationship between you and Caladrius Therapy. A clinical relationship begins only after we complete intake and you sign the appropriate consent forms with a specific clinician.
If you are in crisis
The Site is not monitored 24/7 and is not appropriate for emergencies. If you are in crisis or concerned about your safety or someone else’s safety, do not use the Site to seek help. Call or text 988 (the Suicide and Crisis Lifeline), text HOME to 741741, call 911, or go to your nearest emergency room.
Eligibility
The Site is intended for adults 18 and older. By using the Site, you represent that you are at least 18 years old, or that you are using the Site as the parent or legal guardian of a minor on whose behalf you intend to seek services. The Site is not directed to children under 13, and we do not knowingly collect personal information from them through the Site.
Acceptable use
When you use the Site, you agree that you will not:
- Submit false, misleading, or fraudulent information through any form on the Site, including the consultation form and the therapist match quiz.
- Use the Site to harass, threaten, defame, or otherwise harm Caladrius Therapy, our staff, our clients, or any other person.
- Attempt to gain unauthorized access to the Site, our hosting infrastructure, our practice management vendor, or any related systems; interfere with their normal operation; or circumvent any security or authentication mechanism.
- Scrape, mirror, or otherwise systematically copy content from the Site, or use automated tools to submit forms or generate booking inquiries.
- Upload or transmit viruses, malware, or any other harmful code, or otherwise attempt to disrupt the Site.
- Use the Site in any manner that violates applicable federal, state, or local law, including the laws of the State of North Carolina.
Intellectual property
The Site, its design, text, photography, logos, and other content (other than information you submit and third-party content used under license) are owned by Caladrius Therapy or its licensors and are protected by United States copyright, trademark, and other intellectual property laws. You may view and print pages of the Site for your personal, non-commercial use. Any other use — including reproduction, distribution, modification, public display, or use of our name or marks — requires our prior written permission.
Information you submit
Information you submit through forms on the Site is handled as described in our Privacy Policy. By submitting information, you confirm that the information is accurate to the best of your knowledge and that you are authorized to submit it. Please do not include sensitive health details, diagnoses, or other Protected Health Information in Site forms or unencrypted email; those channels are not appropriate for PHI.
Booking and third-party services
Online scheduling and the client portal are provided through SimplePractice, our practice management vendor. The Site also embeds maps from Google, loads typefaces from Google Fonts, and is hosted by Netlify. Your use of those services is also subject to their respective terms and privacy policies. Caladrius Therapy is not responsible for the content, availability, or practices of third-party websites and services linked from or embedded in the Site.
No appointment confirmation until we respond
Submitting the consultation form or selecting a time in the booking widget does not, by itself, confirm an appointment. Your appointment is confirmed only after a member of our team reaches out, completes any necessary intake steps, and a specific clinician accepts the booking. We aim to respond to inquiries within one business day.
Disclaimer of warranties
The Site is provided on an “as is” and “as available” basis. To the fullest extent permitted by applicable law, Caladrius Therapy disclaims all warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty regarding the accuracy, completeness, timeliness, reliability, or availability of the Site or any information on it. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components, or that any defects will be corrected.
Limitation of liability
To the fullest extent permitted by applicable law, Caladrius Therapy and its members, employees, and contractors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or relating to your access to or use of (or inability to access or use) the Site, including any reliance on information obtained from the Site, interactions with third-party services linked from the Site, or unauthorized access to or alteration of your submissions. Nothing in these Terms limits or excludes liability that cannot lawfully be limited or excluded, including liability for the professional services we provide as licensed clinicians under applicable state law.
Indemnification
You agree to indemnify and hold harmless Caladrius Therapy and its members, employees, and contractors from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your misuse of the Site.
Changes to the Site or these Terms
We may modify, suspend, or discontinue any part of the Site at any time without notice. We may also update these Terms from time to time; when we do, we will post the revised version on this page and update the “Last updated” date below. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
Governing law and venue
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Site that is not resolved informally will be brought exclusively in the state or federal courts located in Mecklenburg County, North Carolina, and you consent to the personal jurisdiction of those courts.
Severability and entire agreement
If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy, Notice of Privacy Practices, and any intake paperwork you sign as a client, constitute the entire agreement between you and Caladrius Therapy regarding your use of the Site.
